Employment Contract for Determined Period

This contract is made on

(مادة 1)
الحق رب العمل للعامل للعمل لديه بوظيفة اعتبارا” من على ان هذا العقد ينتهى فى

(Article 1)
The Employer has employed the employee for the position of This contract is to start on and ends on
(مادة 2)
مدة هذا العقد محدد المده بـ والتى تنتهى فى ولا تتجدد إلا بموجب إتفاق الطرفين بموجب عقد جديد موقع من كل منهما.

وفى حالة رغبة أحد الطرفين فى إنهاء العقد قبل مدته المحددة فعليه أن يخطر الطرف الأخر قبل الإنهاء بشهر على الأقل.

يكون مكان العمل محل هذا العقد فى المقر الذى تحدده الشركة سواء فى الاداره او احد الاسواق التابعه لها.

(Article 2)
The duration of this contract is for that ends on to be renewed only by mutual agreement with a contract signed by both parties.

If any of the both parties require terminating the contract before its determined period, he should inform the other party at least One month prior the termination date.

This contract shall be implemented at the company’s head office or one of the related retail branches locations.
) مادة 3)
اتفق الطرفان على أن يتقاضى العامل راتبآ شهريآ قدره (فقط دينار كويتى لا غير) شهريآ تدفع له فى نهاية كل شهر.
هذا المرتب يشمل بدل الإغتراب و بدل السكن وبدل الإنتقال وبدل عمل بنظام الورديات.

(Article 3)
The Gross monthly salary of the employee shall be (Only KD) to be paid by the end of each month. This salary includes housing, transportation and shift allowances.
) مادة 4)
يلتزم الموظف بتنفيذ كافة الاوامر والتعليمات سواء الشفهية أو الكتابية الصادرة من إدارة الشركة أو رئيسة المباشر .
يحق لرب العمل أن يعهد للعامل بأى عمل يدخل فى نطاق مؤهلاته و خبراته طالما لا يختلف إختلافآ جوهريآ عن عمله الأصلى.
كما يجوز تكليف العامل بالعمل فى أى مكان من الأماكن التى يزاول فيها رب العمل نشاطه بدولة الكيت حسبما يقتضى صالح العمل .

(Article 4)
The employee must follow all orders & instructions, written or verbal, given to him by the management or by his direct supervisor.
The employer retains the right to assign the employee to any other work within his qualification. Furthermore, the employer retains the right to assign the employee to work for any other project that the employer is executing in Kuwait according to work requirements.
(مادة 5)
يجب على العامل احترام لائحة القوانين الداخلية الخاصة بالشركة وفى حالة المخالفة ، يعرض العامل نفسه للمسائلة من الإدارة.
(Article 5)
The employee must respect the internal company rules, In case of default on any such rules or measures, the employee shall be subject to corrective action from the management.
(مادة 6)
على العامل أن يخصص وقته و أقصى جهده لتنفيذ الأعمال المسندة إليه على أكمل وجه.

ولا يجوز له بدون إذن كتابى من رب العمل الإشتغال بأية أعمال أخرى خارج الشركة بعد إنتهاء ساعات العمل بها. كما يتعين على العامل الإحتفاظ بأسرار العمل و ألا يبوح بها لأى شخص.

وعليه فور إنتهاء عمله بالشركة إعادة جميع الأوراق المتعلقة بالعمل و التى فى حوزته إلى رب العمل و إلا كان مسئولآ مسئولية مدنية وجنائيآ.

(Article 6)
The employee must dedicate all his time and effort to efficiently and effectively accomplish his duties.

The employer must not do any other jobs outside the company without a formal written permission from the employer. The employee must also keep all business secrets and must never reveal any of them to any one and under any circumstances.

Furthermore, at the end of the contract, the employee must return and deliver all
the business documents to the employer, otherwise the employee shall be fully responsible with regard to the law.
(مادة 7)
تم الاتفاق على أن يعمل العامل بنظام الورديات وفقآ لأحكام قانون العمل.

(Article 7)
It is agreed the employee shall be working on shift and according to the employment laws and regulations.
(مادة 8)
كل ما لم يذكر فى هذا العقد يرجع بشأنه إلى أحكام قانون العمل الكويتى الاهلى لتسرى أحكامه بين الطرفين.

(Article 8)
Any matter not mentioned in this contract should be referred to the Kuwait labor law, National sector which is the reference of this contract.
(مادة 9)
تختص محاكم الكويت وحدها بالنظر فى المنازعات المترتبة على تنفيذ هذا العقد أو انتهاكه و يكون القانون الكويتى هو الواجب التطبيق.
(Article 9)
Only the Kuwait Courts shall be concerned with any disputes should occur concerning the execution or termination of this contract. Only the Kuwait Law should be applicable for this contract.
(مادة 10)
حرر هذا العقد من نسختين موقع على جميع صفحاته من كلا الطرفين بيد كل طرف نسخة.
يقر العامل أن أى إخطار يرسل له على عنوانه المذكور فى هذا العقد يعتبر إخطارآ صحيحآ ويتعهد بإخطار رب العمل خلال أسبوع من تاريخ التعديل.

(Article 10)
This contract is made of two copies, as each party should hold one copy. The employee admits that any notice sent to his address that is above-mentioned, shall be considered valid and correct. If this address should change, the employee must inform the employer within one week.
